By accessing or using the Endorphine Platform, you agree to comply with and be bound by these Terms.

Endorphine is operated by JStrategia Consulting Services Inc. ("Endorphine" or "we"). Endorphine takes the protection of personal information, which is any information about an individual that, alone or in combination with other available information, can be used to identify that individual, very seriously.

This policy describes how we collect, use, disclose, process and maintain personal information in the course of our business, including the operation of the Endorphine mobile application and website accessible at www.endorphine.ca (collectively or separately, the "Application" or our "Services").

By accessing, subscribing to or using the Application, you consent to the collection, use, disclosure and processing of personal information by Endorphine in accordance with this policy (the "Policy").

This Privacy Policy does not apply to the collection and use of personal information by the Operators of the sites, facilities and activities that are offered through the Application. Endorphine is not involved in, and assumes no responsibility for, the handling of personal information by Operators.

1. Principles applicable to the collection, use, disclosure and retention of personal information

ENDORPHINE will not collect any personal information directly from you without your consent, except in certain limited circumstances permitted by law. ENDORPHINE's collection, use and disclosure of personal information is limited to that which is necessary for the purposes of providing the Services and optimizing their use.

We collect personal information when you create an Account, and use it in the course of providing the Services. You may also provide us with personal information in connection with your use of the Services.

1.1 Responsibility

ENDORPHINE is responsible for the personal information it collects, including personal information disclosed to third parties for processing and administrative purposes.

1.2 Consent

ENDORPHINE shall not collect, use or disclose personal information without the knowledge and consent of the individual, except as authorized or required by law.

1.3 Identifying Purposes

ENDORPHINE collects personal information for a variety of purposes related to its Services, including

To provide the Services and process orders and ticket activations; To respond to questions, comments or requests for information from users; For administrative or marketing purposes in accordance with applicable law regarding commercial electronic messages; For statistical purposes, to allow ENDORPHINE to better understand its customers, their habits and preferences, in order to optimize our services. To enforce the Terms of Use; To provide support services; To comply with its legal obligations.

ENDORPHINE uses personal information only for the purposes for which it was collected or as otherwise permitted by law.

1.4 Limits of Collection

The collection of personal information by ENDORPHINE is limited to that which is necessary for the purposes identified or clearly implied at the time of collection.

ENDORPHINE always obtains personal information by lawful means. ENDORPHINE may collect and use user information from a third party when authorized by law and with the consent of the individual in all other cases.

For example, ENDORPHINE may request and collect the following information in connection with the creation of an account, the use of the Application and the processing of an order

First and Last Name, Email Address, Phone Number and any other information you may provide when using the Application; Preferences, including Operators and Activities and other personalized settings; Usage data each time you use the Application; When you purchase tickets through the Application. When you give us explicit permission to access your contact or geolocation data.

2. Retention of Personal Information

ENDORPHINE retains personal information for as long as it is reasonably needed for the purposes for which it was collected or as required by law. Upon deletion of a User Account, ENDORPHINE will retain a user's personal information for as long as required to comply with the law or to protect its rights, and to enforce this Policy and the Terms of Use. Thereafter, such information will be anonymized or destroyed in a secure manner.

3. Disclosure of Personal Information

ENDORPHINE does not disclose personal information for purposes other than those for which it was collected, except with the consent of the individual or as required or permitted by law, and limits disclosure of and access to personal information to only those persons who need it for the purposes identified.

Within ENDORPHINE, access to personal information is limited to those employees who need the information to perform their duties. Furthermore, ENDORPHINE will only disclose Personal Information to third parties for the purposes identified or implied in this Policy or at the time of collection, with your express consent, or as otherwise required or permitted by law.

In particular, ENDORPHINE may share personal information with trusted partners or suppliers who act as subcontractors or processors (in the case of payment processors) for the following purposes

to process payments for tickets purchased through the Application; to provide services on our behalf, including delivering orders, hosting or operating the Application, sending and managing email, analyzing customer data and needs to improve or create new products, services or the Site. In connection with a business transaction, if necessary to make a decision to proceed with the transaction; To fulfill any of the purposes indicated in this Policy and any other purpose that may be indicated, at the latest, at the time the information is collected.

ENDORPHINE will ensure that all third parties with whom it does business and to whom it provides personal or confidential information also guarantee, to the same extent as we do, the confidentiality, security and integrity of the information they hold on behalf of ENDORPHINE.

4. Access

Subject to applicable laws and upon receipt of a written request from an individual, ENDORPHINE will indicate whether it holds personal information about that individual and will provide access to that information in accordance with the law.

5. Rectification and Updating of Personal Information

ENDORPHINE aims to ensure that the personal information it collects is as accurate and complete as necessary for the purposes for which it is to be used.

A user may request that his or her personal information be corrected or updated. This can be done by modifying the user's account profile.

6. Security, hosting and storage

ENDORPHINE undertakes to apply and require its subcontractors and payment service providers to apply physical, technological and administrative security measures in order to maintain the confidentiality of personal information and to protect it against theft, loss, disclosure or unauthorized access.

Notwithstanding the foregoing, no method of electronic data transmission or storage is infallible. ENDORPHINE cannot guarantee the security of personal information transmitted or stored through the Application and therefore cannot guarantee that the confidentiality, integrity and availability of such information will not be compromised.

7. Non-personal information

Non-personal information collected by ENDORPHINE is intended to enable the use, operation, improvement and development of the Application. In particular, the Services may include cookie technology to improve the quality of the Services and to better meet the expectations of users. Cookies are anonymous and are not used to collect any personal data, but only for the purpose of connection, delivery and improvement of the Services.

In addition, your equipment and the site server automatically exchange certain information when you access the Services. This is necessary for the server to transmit a file compatible with the computer equipment you are using. The information exchanged may include, but is not limited to, the following:

your IP address (the unique number assigned to your computer when it is connected to the Internet) and your Internet Service Provider; the type of browser (Explorer, Safari, Firefox, etc.) and operating system (Windows, Mac OS, etc.) you are using to access the site the date and time of access; the pages you visit; the address of the referring site, if you access the site from another site.

This information is kept and used by ENDORPHINE for technical and statistical purposes, in particular to count the number of visits, the most visited pages, the technology used by users, the referring sites and the geographical origin of visits.

We inform you that you can configure your browser to prevent the recording of cookie tokens. Please note that if you refuse our cookie tokens, some functions and features of the Services may not function properly.

8. Links to Other Sites

The Application may contain hyperlinks to other sites. These other sites are not under the control of ENDORPHINE and we are not responsible for the manner in which these sites treat personal information. Information exchanged on those sites is not subject to this Policy, but to that of the external site, if any. We strongly recommend that you review or consult the privacy policies and terms of use of those sites.

9. Use of cookies

Our Website uses cookies and other related technologies (for simplicity, all these technologies are referred to as “Cookies”). Cookies are also placed by third parties used to collect statistics.

What is a cookie?

A cookie is a small file sent by the pages of the Website and stored by your browser on the hard drive of your computer or other device. The information stored there may be sent back to our servers or the servers of the relevant third parties on a subsequent visit.

What is a script?

Third parties

Statistics monitoring cookies

ENDORPHINE uses statistics monitoring cookies to optimize the experience of Users on its Website and its Web App. With these cookies, ENDORPHINE obtains observations on the use of its Website and its Web App.

Marketing/tracking cookies are cookies, or any other form of local storage, used to display advertising or to track the user across the Website or across multiple websites for similar marketing purposes.
